Terms and conditions of sale
The CERTEC Boutique is an e-commerce site accessible via the Internet at www.certec.fr. It is open to all users of this network. It is produced by Mr Stéphane JARICOT under the name of SARL CERTEC, registered in the Lyon Trade and Companies Register under Siren number 325 600 088 00026.
The site enables SARL CERTEC to offer products for sale to Internet users browsing the site. Prior to placing an order, the buyer declares that he/she has full legal capacity, enabling him/her to commit to the present terms and conditions of sale. Any order for a product offered on the site implies consultation and express acceptance of these terms and conditions of sale, without this acceptance being conditional on a handwritten signature by the user. In accordance with the provisions of articles 1316 to 1316-4 of the French Civil Code, supplemented by Decree no. 2001-272 of March 30, 2001, issued for the application of article 1316-4 of the French Civil Code and relating to electronic signatures, it should be noted that validation of the order form, as specified in article 3.3. below, constitutes an electronic signature which, between the parties, has the same value as a handwritten signature. The user may save or print these general terms and conditions of sale, provided they are not modified.
1. Purpose
The purpose of these general terms and conditions of sale is, on the one hand, to inform any potential consumer of the terms and conditions under which the seller proceeds with the sale and delivery of the products ordered and, on the other hand, to define the rights and obligations of the parties in the context of the sale of products by the seller to the consumer. They apply, without restriction or reservation, to all sales by SARL CERTEC of products offered on its website. CERTEC reserves the right to modify these terms and conditions of sale at any time. In this case, the applicable conditions will be those in force at the date of the buyer’s order.
2. Products and prices
2.1. Products
In accordance with Article L. 111-1 of the French Consumer Code, the user may, prior to placing an order, acquaint himself on the CERTEC website with the essential characteristics of the product(s) he wishes to order. The buyer selects one or more products from the various categories offered on the website. The offers presented by SARL CERTEC are valid while stocks last. The company reserves the right to modify the product assortment, in particular according to the constraints of its suppliers. The photographs, graphics and descriptions of the products offered for sale are indicative only and are not binding on the seller. In the event of a supplier modifying a product, the seller cannot be held responsible for its graphic representation, nor can it affect the validity of the sale.
2.2. Prices
The sale prices of products on the SARL CERTEC website, indicated in euros, are those in force at the time the order form is registered by the purchaser. The prices shown include shipping and handling costs for orders within France. For the European Union, a flat-rate charge starting at 16 euros (excl. VAT) must be added to the price of the product(s). For international shipments, please consult us. Prices include VAT, as SARL CERTEC is subject to Value Added Tax at 20% (FR 91 325 600 088). However, any change in the applicable rate will be automatically reflected in the price of the products sold. CERTEC reserves the right to modify product prices at any time. The purchaser will be informed of any such changes before placing an order.

3. Order registration and validation
3.1 Browsing the Site
The user may view the various products offered for sale by SARL CERTEC on its site. The User may browse freely through the various pages of the Site, without being bound by any order. The user is responsible for any telecommunication costs incurred in accessing the Internet and using the site.
3.2 Ordering
Any order implies unreserved acceptance of these terms and conditions of sale. Once the purchaser has registered his/her order by clicking on the “Confirm my order” icon, he/she is deemed to have accepted, with full knowledge of the facts and without reservation, the present terms and conditions of sale, and the prices, volumes and quantities of the products offered for sale and ordered. If the user wishes to place an order, he/she will select the various products in which he/she is interested, and will express said interest by clicking on the “Add to basket” box. At any time, the buyer may : – obtain a summary of the products they have selected, or modify their order, by clicking on “My basket” on any page, – complete their product selection and order by clicking on “Confirm my order”. A summary of the order will then appear on the screen. If the list presented corresponds to the products chosen, the buyer validates the summary by clicking on : “Confirm my order”. The buyer must then identify him/herself, either by entering his/her e-mail address and password, if he/she is already a customer, or by accurately filling in the form provided, on which he/she will include the information necessary for his/her identification, such as his/her surname, first name and postal address. The purchaser is informed and accepts that the entry of any identifier constitutes proof of his/her identity and expresses his/her consent. Once identified, an order form will appear on the screen, summarizing the details of the order: the nature, quantity and price of the products selected by the purchaser, as well as the total amount of the order, the purchaser’s contact details and the delivery address of the products.
3.3. Final validation of the order
After checking the status of the order, and once all the information requested has been completed by the Buyer, the latter will click on the “Confirm my order” box to pay for the order. He/she will choose the means of payment he/she wishes to use to pay for his/her order, it being understood that the buyer must have the means of payment defined in article 4 below. He/she will click on the button corresponding to the means of payment he/she has chosen. The sale will not be considered final until CERTEC has sent the buyer confirmation of the order and has received payment in full. SARL CERTEC recommends that the buyer keep this information on a paper or computer document. Any fraudulent order or order presumed to be fraudulent will be considered by SARL CERTEC as null and void. No order will be sent if payment has not been made by the purchaser.
4. Payment
Payment must be made at the time of ordering. Without this payment, no goods will be sent. At no time may the sums paid be considered as deposits or advance payments. All orders are payable in euros. The purchaser guarantees that he/she has the necessary authorizations to use the method of payment he/she has chosen when registering the order form. SARL CERTEC reserves the right to suspend or cancel any order and/or delivery, whatever its nature and level of execution, in the event of non-payment of any sum due by the purchaser, in the event of a payment incident or in the event of an existing dispute with the purchaser. Penalties of an amount equal to the legal interest rate plus five points are automatically applicable to amounts unpaid at the end of a period of ten days following the invoice date, or upon notification of rejection of bank payment for any other means of payment. Delivery of any new order may be suspended in the event of late payment of a previous order, notwithstanding the provisions herein. For all payments, SARL CERTEC reserves the right to request a photocopy of the purchaser’s identity card and, where applicable, that of the holder of the means of payment used by the purchaser. As part of the fight against Internet fraud, information relating to your order may be transmitted to any third party for verification. The following payment methods are available to the buyer: bank transfer, bank cheque (France only) and bank card via e-transaction from Crédit Agricole. – Bank transfers: In the case of payment by bank transfer, the purchaser must indicate the order number on the order form. SARL CERTEC will ship the products upon receipt of the funds corresponding to said order. SARL CERTEC will send the products at the earliest 5 working days after cashing the cheque corresponding to the said order, subject to provisions. To cancel an order before the cheque has been sent, simply send an e-mail to contact@certec.fr, specifying the order number. – Credit cards accepted on the site, via the secure E-transaction module of Crédit Agricole. Please note: MasterCard is not accepted.
5. Coupon codes and gift cards
Coupon codes and gift cards must be entered in the “coupon code” box when ordering in order to be activated. Gift cards can be used on a one-off basis for an amount equal to or greater than the amount ordered (no reimbursement of the difference will be made). They are valid for 6 months from the date of purchase. The amount of the card can be €20, €30, €40 or €50. Only one card can be used per order. CERTEC cannot be held responsible for loss or damage resulting from loss, theft or unauthorized use of the cards. Gift cards cannot be refunded, even partially, exchanged, resold, credited to a card or bank account, discounted, replaced or reimbursed when they expire. In the event of loss or theft, the gift card may be cancelled by telephone, e-mail or post.
6. Choice of products
The purchaser, having familiarized himself/herself with the products and their characteristics marketed by SARL CERTEC, has, under his/her sole responsibility and according to his/her needs as previously determined prior to any order, made his/her choice of the product(s) forming the subject of his/her order. Furthermore, the purchaser is the sole judge of the compatibility of the products ordered with those he/she uses, as he/she alone knows the products he/she owns and uses. It is the sole responsibility of the purchaser, if he does not consider himself sufficiently competent, to seek the assistance of an advisor.
7. Delivery and acceptance
7.1. General rules
Products will be delivered to the address indicated by the purchaser on the order form, which must be consistent with the previously agreed geographical area. By default, invoices are sent to the e-mail address indicated by the customer at the time of registration. In the absence of compliance with the procedures set out below, no claim by the purchaser will be accepted.
7.2 Delivery times
All parcels weighing less than 1 kilogram and not containing gas cartridges will be sent by La Poste (France). Delivery times and delays are therefore not our responsibility. Any parcel over 1 kilogram and/or containing gas cartridges will be sent by carrier. Transport time is 24/48 hours for France (excluding Corsica and Brittany 48/72h). ATTENTION: this does not include manufacturing time. For Europe, delivery takes a minimum of 3 days. International: varies by country. Any overrun of the lead time indicated on the product sheet shall not give rise to damages, withholding or cancellation of the order by the purchaser. Manufacturing lead times vary from product to product. Please contact us. Average lead time: 3/4 weeks.
7.3 Delivery conditions and tracking
Delivery is free of charge for all orders over €16 (incl. VAT) delivered within France. European Union: A flat-rate charge applies for deliveries within the European Union.
8. Retention of title
SARL CERTEC retains full and complete ownership of the products sold until full payment has been received, in principal, costs and taxes included.
9. Liability
SARL CERTEC may not be held liable for non-performance of the contract in the event of stock shortage or unavailability of the product due to force majeure, disruption or total or partial strike, notably of postal services and means of transport and/or communications. The SARL CERTEC site also contains information from third parties, and links to other Internet sites. SARL CERTEC cannot be held responsible for any damage resulting from the use of, access to, or inability to use this third-party information, nor for the content of other Internet sites.
10. Partial invalidity
If one or more stipulations of these general terms and conditions of sale are held to be invalid or declared as such in application of a law, regulation or following a final decision by a competent court, the other stipulations will retain their full force and scope.
11. Non-waiver
The fact that one of the parties does not avail itself of a breach by the other party of any of the obligations referred to in these general terms and conditions of sale shall not be construed as a waiver of the obligation in question for the future.
12. “Information Technology and Civil Liberties
12.1 Personal information
The personal information collected in the context of distance selling is compulsory, as this information is necessary for the processing and delivery of orders and for the preparation of invoices. This information is strictly confidential. Failure to provide this information will result in automatic rejection of the order. In accordance with the French Data Protection Act no. 78-17 of January 6, 1978, the processing of personal data collected on the site has been declared to the Commission Nationale de l’Informatique et des Libertés (currently being validated). Users have the right to access, modify, rectify and delete data concerning them. To exercise this right, the User should send a letter to the Customer Service Department: SARL CERTEC 257 route du Bourg 69210 SOURCIEUX-LES-MINES.
12.2 Cookies
SARL CERTEC reserves the right to install cookies on the computers of visitors to its website. A cookie does not allow us to identify you. It is a computer file stored on the hard disk of the user’s computer. Its purpose is to indicate a previous visit by the user to the site. Cookies are only used by SARL CERTEC to personalize the service offered to the user.
13. Intellectual property
All elements of the site are the exclusive intellectual property of SARL CERTEC. No one is authorized to reproduce, exploit, rebroadcast, or use for any purpose whatsoever, even partially, any elements of the site, whether software, visual or audio.
14. Photos
Photos are non-contractual. All photos in the online store are published for information purposes only. CERTEC undertakes to represent to the best of its ability the reality of the products shown in the photos published in the online store.
